INTRODUCTION
These Terms of Use present the General Conditions that regulate the purchase of products offered on the website www.gpmedicos.com, owned by Gagliardini & Patricio Lda (hereinafter referred to as GPMédicos). The purchase of any of the products implies full and unreserved acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of the Specific Conditions that may be applicable when purchasing certain products. These General Conditions may be modified without prior notice, so it is advisable to read their content carefully before purchasing any of the products offered.

SCHEDULING PRODUCTS OR SERVICES
The products or services offered, together with their main features and price, are displayed on the screen. GPMédicos reserves the right to decide, at any time, which products and/or services are offered to Customers. Therefore, GPMédicos may, at any time, add new products and/or services to those currently offered. Likewise, GPMédicos reserves the right to withdraw or cease offering, at any time and without prior notice, any of the products offered.
All this without prejudice to the fact that the acquisition of any of the products can only be made through the subscription or registration of the USER, with GPMédicos providing the interested party with a username and password, which will identify them and allow them to personally access the products.
Once inside www.gpmedicos.com, and to access the contracting of the different products, the USER must follow all the instructions indicated in the purchase process, which will imply reading and accepting all the general and specific conditions established at www.gpmedicos.com.
NOTES
The offers presented by GPMédicos are valid within the limits of available stocks. GPMédicos reserves the right to modify the range of its products in accordance with the restrictions imposed by its suppliers.
The product purchased may undergo, due to the manufacturer's availability, non-substantial modifications to the components, characteristics or performance of the batch from which it is composed, as long as these do not affect the qualities and performance advertised. Likewise, this information may contain inaccuracies or typographical errors, which may be changed, corrected or deleted at any time. GPMédicos may make changes or modifications to the products at any time. THE IMAGES PUBLISHED ARE FOR ILLUSTRATIVE PURPOSES ONLY.
WARNING
The user must, in any case, and before purchasing an item sold, ensure that it is suitable for the use he/she intends to make of it. The user is responsible for following and respecting the safety instructions and recommendations mentioned in the instructions for each product. If you have any questions about the use of the products, GPMédicos suggests that you send an email to our clinical department using the contacts described and follow the instructions provided. GPMédicos cannot be held responsible for any injury, damage or harm caused by not following the recommendations mentioned above.
PRODUCT EXCHANGES AND REPLACEMENTS
GPMédicos intends to guarantee the availability of all products that are advertised through www.gpmedicos.com. However, in the event that any product ordered is not available or if the product is out of stock, the customer will be informed within 24/48 hours after placing the order. In the event that the product is not in stock at the time of the order, the user will have the possibility to RESERVE the product in question, so that it can be supplied as quickly as possible.
If the product is not available and the consumer has been informed of this, GPMédicos may supply a product with similar characteristics without increasing the price, in which case the consumer may accept or reject it, exercising his/her right to withdraw and terminate the contract.
In the event of total or partial unavailability of the order and rejection of the replacement products by the customer, the refund of the payment will be made within 15 working days.
PURCHASE PROCESS OR SERVICE SCHEDULING
To make any purchase on www.gpmedicos.com, the customer must be of legal age.
It will also be necessary or preferable for the customer to register on www.gpmedicos.com using a data collection form in which he/she provides GPMédicos with the information necessary for the purchase; data that in any case must be true, accurate and complete about his/her identity and that the customer must expressly consent to by accepting GPMédicos' privacy policy.
It is also recommended that the customer prints and/or saves a copy of the terms and conditions of sale on a durable medium when placing an order, as well as the receipt sent by GPMédicos by email. To cancel an order, the user must request the cancellation by logging into their customer area, in order to give it the highest priority and, therefore, cancel the shipping of the order. If this is not possible, they can contact us using the usual contacts.
IMPORTANT: Cancellation requests made by email, internal message, etc. will only be taken into account when the original email of the order that the customer received is forwarded, in order to identify the order number without fail.
CANCELLATION OF APPOINTMENTS
GPMedicos does not accept cancellations of services through the system, since these appointments take up the professionals' diaries and represent a cost that cannot be ignored. Therefore, cancellations of appointments will not be accepted, nor will the amount paid be refunded if the customer does not contact us within 48 hours of the scheduled event, explaining the reason for cancellation. GPMedicos reserves the right not to accept other cancellations if it finds that they will cause irreversible economic losses, and the purchase of an appointment should be considered definitive. However, within the approved rules, GPMedicos allows the customer to attempt to change the appointment previously made in their profile.
PROMOTIONS AND DISCOUNT COUPONS
GPMédicos may present customers with coupons with discount codes that can be used exclusively for online purchases. It is important to note that no coupon or promotion can be applied to subscriptions or service packs, as these already include permanent discount prices or lower prices than the services contracted at the unit.
Depending on their specificities, coupons can be used to purchase products in the online store or to schedule services.
Customers may receive emails with coupon codes that must be used on the website, on the purchase page prior to payment, with the codes being applied in the respective discount fields that may have the following designation (unless future changes are made): "Enter a promotional code".
IMPORTANT: please note that some codes only apply to the purchase of products from the online store and others to the purchase of services in scheduled appointments. Under no circumstances may the coupon be used for in-person purchases, nor, as previously mentioned, for the purchase of subscriptions or packs.
IMPORTANT: All coupons are valid for a maximum of 1 year. After this date, they will no longer be valid. The customer may contact GPMédicos and request that the validity period be renewed or extended. GPMédicos reserves the right to accept or reject the User/Customer's request.
GIFT VOUCHERS
GPMedicos offers its customers the possibility of offering a gift voucher for a monetary value to a friend, colleague or company to be used whenever the person or entity receiving the gift wishes. To use the gift voucher, the customer must enter the code received from the voucher in the field called "Redeem gift voucher"
IMPORTANT: Gift vouchers have the same rules as coupons with regard to a maximum validity of 1 year. After this date, they lose their validity. The customer may contact GPMedicos and request that the validity period be renewed or extended. GPMedicos reserves the right to accept or reject the User/Customer's request.
LOYALTY AND POINTS PROGRAM
GPMedicos offers its users a points program with the conditions described on the page https://www.gpmedicos.com/cartao-pontos, and the customer may consult these conditions on our website. Only users registered at www.gpmedicos.com can benefit from this program. The user can use the points to redeem discount coupons with the general coupon rules mentioned above. GPMédicos reserves the right to change the conditions of this program at any time and without prior notice.
BILLING PROCESS
Our website allows you to schedule services and sell products and even purchase gift vouchers. Considering that the customer can cancel the order or cancel the appointment within certain time frames, the customer must request the invoice for their purchase immediately after the scheduled service has been performed or the product ordered has been received. The invoice will be sent within a maximum period of 24/48 hours to the contact details provided by the customer. The customer can request this document through the contact page https://www.gpmedicos.com/contactos indicating the order number for their purchase or forwarding the receipt email to geral@gpmedicos.pt
DELIVERY OF PRODUCT ORDER
The order will be delivered to the address designated by the customer at the time of purchase, depending on the method chosen. The scope of delivery includes the following areas: Mainland Portugal.
Orders will be delivered to the person and address indicated in the order. Orders will be delivered to the customer by courier companies or other companies that carry out deliveries. The order will be considered delivered when the carrier delivers the order to the customer, and the customer signs the delivery receipt document. It is the customer's responsibility to check the condition of the packaging (orders/packaging) upon receipt and indicate any anomalies on the delivery note (essential condition, otherwise no claim for transport breakage will be accepted).
At the time of delivery, as soon as the customer takes possession of the goods, the risk of loss or damage is transferred to him/her. It is therefore important to:
- Do not sign the delivery note until you have checked the condition of the boxes and, if possible, the condition of the goods.
- Do not give in to pressure from delivery personnel; take the time to examine your goods.
If, upon inspection, you find that the goods do not conform to the order or have been damaged during transport, you have the option of rejecting the goods, explicitly indicating your reservations on the delivery note (a mandatory condition for making any claim for breakage or damage during transport).
Orders will be sent to the customer within 5/10 days (working days), provided that the customer has placed the order before 4:00 p.m. No deliveries or deliveries will be made on weekends and public holidays. The estimated delivery time is 5 days after dispatch (provided that all products in the order are in stock), except for palletised orders (bulky orders), in which case delivery may take 5/15 working days. IMPORTANT: The standard delivery service DOES NOT INCLUDE delivery to the customer's home, delivery is made in front of the address.
PRICES, CHARGES AND TAXES
The prices of the products listed on www.gpmedicos.com will be expressed in euros, unless otherwise indicated, and will be guaranteed for the duration of their validity and regardless of the destination of the order.
The final prices of all products (and, where applicable, the final prices per unit of measurement, when mandatory) together with their characteristics, offers, discounts, etc., are shown in each of the items that appear in the catalogue at www.gpmedicos.com.
- VAT is included in the products.
- The VAT rate is 23%, except for companies registered in the Intercommunity Transactions Registry.
- Shipping costs: Shipping costs will be borne by the end customer, in the case of individuals.
- Other additional costs: Return costs: depending on the type of return, collection costs will be borne by the customer.
Product prices may vary at any time. In this case, the price to be applied will be the price in force on the date the order was placed. In any case, the final cost will be communicated to the customer during the electronic purchase process before the customer formalizes their acceptance.
AVAILABLE PAYMENT METHODS
The following payment methods are available:
1. By credit or debit card
You can make the payment immediately through our Bank's secure SSL payment gateway. If any refund or cancellation of the order is necessary, the amount will be refunded to the same payment card. Both personal data and bank details will be protected with all the security measures established by the Organic Data Protection Law and its Development Regulation with total confidentiality. GPMedicos accepts payments with VISA, Verified by VISA, MasterCard and MasterCard SecureCode. The bank issuing the card must be located in Portuguese territory. When placing the order, the customer will provide their card details, which will be stored directly in 4B Gateway during the purchase process. GPMedicos does not store credit card information. For internal reasons of the Organization, the collection management is carried out through Banco Santander, without any consequences for the customer.
2. PayPal
Payment for the order will be authorised via PayPal, but no funds will be withdrawn until PayPal has verified that it is correct. To do so, it will be essential to have a PayPal account.
RETURNS AND WITHDRAWAL POLICY
According to the regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 working days without having to state a reason and without incurring any costs, except those provided for in art. 107.2 and 108 of RD1/2007, of 16 November, which approves the text referred to in the General Law for the Protection of Consumers and Users.
The customer will have a maximum period of 14 working days from the day of receipt of the goods or product ordered to inform GPMédicos of their wish to terminate the contract.
Withdrawal implies that GPMédicos will refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for payment. During this period, the consumer must inform GPMédicos of their decision to terminate the contract, using the form available on the website at https://www.gpmedicos.com/contactos and sending it. GPMédicos will send the consumer a notice of receipt of the withdrawal on a durable medium. To return a product, it is essential that it is in perfect condition, disassembled and with all its accessories. Once your request has been received, we will contact the customer to indicate the details of the return. The customer will bear the cost of returning the goods.
VERY IMPORTANT: Products in the PERSONAL CARE category cannot be returned once their original packaging has been opened.
NOTES
Any product handled by the customer in case of misuse, breakage, etc. will not be exchanged or credited; otherwise, any warranty will be lost. In the event of a defective product, shipping costs will be borne by GPMédicos. In all other cases, these must be borne by the customer. If the cancellation of the order is communicated before shipping, the customer will be exempt from any costs. In the event of a replacement product, it may not necessarily be the same as the previous one, but in any case an improved version or model, as products are subject to continuous improvement. Both the collection of the product and its return will be managed by Sklum through our shipping service.
COMPLAINTS
To submit any complaint or claim to GPMédicos, the customer must contact the customer service department by sending an email to reclamacoes@gpmedicos.pt or using the contact form on our website at https://www.gpmedicos.com/contactos
In accordance with the EU Consumer Online Dispute Resolution and in accordance with article 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform that is available at the following link: http://ec.europa.eu/consumers/odr/
LEGISLATION AND JURISDICTION
The parties submit, at their choice, to the courts of the user's domicile for the resolution of disputes and waive any other jurisdiction. The language used must be Portuguese.
In the event that any user or third party considers that there are facts or circumstances that reveal the illegality of the use of any content and/or the carrying out of any activity on the web pages included or accessible through the website, they must send a notification to GPMédicos and correctly identify and specify the alleged violations.
